1. Scope of Enterprise Services

Empower Global Tech provides end-to-end digital architecture. Specific deliverables, Service Level Agreements (SLAs), pricing, and project scopes for IT infrastructure, telecommunications, and digital marketing will be governed by individual Master Services Agreements (MSAs) or specific contracts signed during client onboarding. In the event of a conflict between these website terms and a signed MSA, the MSA shall prevail.

2. Website Acceptable Use and Accounts

When using our website or client portals, you agree not to use the site for any unlawful purpose, to solicit others to perform unlawful acts, or to violate any international, federal, or state regulations (specifically including New South Wales and Australian federal law). If you create an account or use our wholesale/white-label portals, you are responsible for maintaining the confidentiality of your account and password and for restricting access to your computer or device.

3. Telecommunications Compliance (CSP)

As a registered Carriage Service Provider (CSP) in Australia, our telecommunications, internet, and VoIP services are provided in strict accordance with the Telecommunications Act 1997 (Cth) and relevant ACMA regulations. Customers utilising our network must not use the service for illegal, fraudulent, harassing, or abusive purposes. We reserve the right to suspend or terminate telecommunications services immediately if network integrity is threatened or legal compliance is breached.

4. Digital Visibility & AI Search Guarantees

Our Tri-Pillar Visibility framework utilises advanced engineering to optimise your digital presence for Large Language Models (LLMs) and traditional search engines. However, Empower Global Tech does not guarantee specific search rankings, AI Share of Voice (SOV) percentages, or third-party algorithm behaviours. Search engines (e.g., Google) and AI models (e.g., ChatGPT, Gemini, Perplexity) update their systems continuously, and results will naturally fluctuate.

5. Intellectual Property

The website and its original content, features, and functionality are owned by Empower Global Tech Pty Ltd and are protected by international copyright, trademark, and other intellectual property laws.

For our digital visibility clients: All custom JSON-LD schema, network architectures, and proprietary AI search strategies developed by us remain our intellectual property until full payment is received. Upon settlement, clients are granted a perpetual, non-exclusive license to use the developed web assets.

6. Links to Third-Party Websites

Our website may contain links to third-party web sites or services (such as vendor portals or compliance regulators like the TIO) that are not owned or controlled by Empower Global Tech. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party web sites or services.

7. Limitation of Liability & Australian Consumer Law

Our services come with guarantees that cannot be excluded under the Australian Consumer Law (ACL). For major failures with the service, you are entitled to cancel your service contract with us and to a refund for the unused portion.

To the maximum extent permitted by law, Empower Global Tech Pty Ltd shall not be liable for any indirect, incidental, special, consequential, or punitive damages—including without limitation, loss of profits, data, network downtime, or business interruptions—arising from your access to or use of our website, IT networks, or telecommunications services. Our total liability is limited to the resupply of the services or the cost of having the services resupplied.

8. Modifications to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect. Continued use of our website or services after those revisions become effective constitutes agreement to the revised terms.

9. Governing Law

These Terms shall be governed and construed in accordance with the laws of New South Wales, Australia, without regard to its conflict of law provisions. Any disputes arising from these terms will be subject to the exclusive jurisdiction of the courts of New South Wales.
